By accessing and using the Apex Academy website (www.apexacademy.com) and its associated services, including online courses, learning materials, and community forums (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). 3. Course Enrollment and Access

By enrolling in a course, you are granted a limited, non-exclusive, non-transferable license to access and use the course materials for your personal, non-commercial educational purposes only. You agree not to share, reproduce, distribute, or otherwise exploit the course materials in any way that violates these Terms or the intellectual property rights of Apex Academy or its instructors.

Course fees are subject to change without notice. Apex Academy reserves the right to modify, suspend, or discontinue any course at any time. In the event that a course is discontinued after you have enrolled, we will provide you with a full refund of the course fee or offer you the option to enroll in a comparable course.

Completion of a course does not guarantee employment or any specific outcome. The value and benefit you derive from the courses will depend on your individual effort, skills, and circumstances.

4. Intellectual Property

The Services and all content included therein, including but not limited to text, graphics, logos, images, audio clips, video clips, and software, are the property of Apex Academy or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, modify, distribute, or display any of the content without the prior written consent of Apex Academy.

5. User Content

APEX ACADEMY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

APEX ACADEMY MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF THE CONTENT AVAILABLE THROUGH THE SERVICES. YOU ARE SOLELY RESPONSIBLE FOR YOUR USE OF THE SERVICES AND YOUR RELIANCE ON ANY CONTENT. YOUR USE OF ANY INFORMATION OR MATERIALS ON THIS WEBSITE IS ENTIRELY AT YOUR OWN RISK, FOR WHICH WE SHALL NOT BE LIABLE.

8. Limitation of Liability

IN NO EVENT SHALL APEX ACADEMY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF APEX ACADEMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

APEX ACADEMY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO APEX ACADEMY FOR THE SERVICES IN THE SIX (6) MONTHS PRIOR TO THE DATE OF THE CLAIM.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Menlo Park, California, and you consent to the jurisdiction of such courts.
